Agreement

  1. Failure to oblige with any and all agreement terms and conditions of service results in the termination for default of this agreement.
    1. AlFa Estates for any reason at any time may call for a termination for default of this agreement.
    2. Security deposit becomes forfeited, immediately due and payable upon the termination for default of this agreement.
    3. Any property left within the unit after termination of agreement is forfeited and may be sold or auctioned.
    4. Physical damage will result in the termination for default of this agreement.
      1. If value of aforementioned condition exceeds security deposit, the difference will be added to the full amount of security deposit.
    5. Stolen property will result in the termination for default of this agreement.
      1. If value of aforementioned condition exceeds security deposit, the difference will be added to the full amount of security deposit.
    6. Malicious activities and/or behavior to property and/or residence will result in the termination for default of this agreement.
      1. If value of aforementioned condition exceeds security deposit, the difference will be added to the full amount of security deposit.
    7. Illegal activities and/or substances within the property will result in the termination for default of this agreement.
    8. Failure to submit a complete and true application to the best of applicants knowledge will result in the termination for default of this agreement.
    9. Applicant certifies that all of the information provided is correct and complete and realize that falsification or misrepresentation, including omission, on this or any other personnel record, or in the application and renting process, may be grounds for refusal of service, or if approved, may lead to fines, up to and including termination.
    10. By accepting the Agreement acknowledgment, applicant agrees that Agreement acknowledgment is a legally binding equivalent to applicants handwritten signature. Whenever applicant executes the Agreement acknowledgment, it has the same validity and meaning as a handwritten signature. Applicant will not, at any time in the future, repudiate the meaning of any Agreement acknowledgment or claim that applicants Agreement acknowledgment is not legally binding.
    11. All used and remaining unused months of premium becomes forfeited, immediately due and payable upon the termination for default of this agreement.
  2. Each applicant considering residency must submit an application for qualification and approval process.
    1. Applicant declares (or certifies, verifies, or states) under penalty of perjury that the submitted application is true and correct to the best of applicants ability.
    2. Applicants must be at least 18 years of age to apply.
      1. Applicants under the age of 18 must be accompanied by a co-signer over the age of 18.
    3. Applicant must submit or provide a legal form of identification.
    4. Applicant must submit or provide a legal birth certificate.
    5. Applicants with below average or average credit worthiness must be accompanied by a co-signer with above average credit worthiness.
  3. Property selection shall be determined on the Application.
    1. Agreement is for residency at selected property in exchange for Standard Rate Premium.
      1. Standard Rate Premiums are per month, per resident.
    2. Length of Residency Commitment options (listed below) shall be determined on the application. Premiums apply based on the following lengths of stay, per resident:
      1. 2 months (additional rate options apply, as selected).
      2. 3-5 months (additional rate options apply, as selected).
      3. 6-9 months (additional rate options apply, as selected).
      4. 10-11 months (additional rate options apply, as selected).
      5. 12 months (Standard Rate Premium).
    3. Utilities.
      1. Utilities are priced at an all inclusive rate per month (additional rate options apply, as selected).
      2. Utilities are all inclusive and shall cover reasonable usage needs, as selected.
      3. Unreasonable overage use of utilities to be penalized at an additional cost.
    4. Parking.
      1. Available at an additional monthly cost per vehicle (additional rate options apply, as selected).
      2. Vehicle Identification Numbers and License Plate Numbers must be provided for each vehicle requiring parking.
    5. Pets.
      1. Pets are welcome as a medical companion and for medical purposes at an additional monthly cost per pet (additional rate options apply, as selected).
      2. All proper paperwork must be submitted when housing pets.
      3. Additional care must be used when housing pets due to sanitation and cleanliness reasons.
      4. Pet feces and urine must be promptly cleaned and sanitized due to sanitation and cleanliness reasons.
      5. Failure to provide adequate cleanliness and sanitation practices for housed pets will result in a penalty of $150 per incident, per resident.
    6. Maintenance.
      1. Common space areas (ex. hallways, laundry room, kitchen, dining room, living room, etc.) must be within reasonable living conditions and maintained reasonably.
        1. Failure to do so will result in a penalty of $150  per applicant, per week until unit is within reasonable living conditions.
      2. Maintenance service personnel’s may be assigned or requested to a unit from time to time for mandatory or optional service work (ex. floor recondition, painting, plumbing, physical repair to the property, etc.).
        1. It is the responsibility of all applicants to accommodate to the needs and assistance of any maintenance personnel’s to successfully and efficiently complete duties.
        2. Failure to accommodate and assist maintenance personnel’s to successfully and efficiently complete duties will result in a penalty of $150 per applicant.
    7. Each resident must be covered under a minimum $100,000 Renters Insurance Policy.
      1. Proof of Renters Insurance Policy must be provided.
      2. Tenant agrees unconditionally that AlFa Estates and/or any of its representatives are not to be held liable in any way for any damaged, lost or stolen properties or items.
      3. Tenant agrees unconditionally that AlFa Estates and/or any of its representatives are not to be held liable in any way for any harm, injury or fatality to any persons on the premises.
      4. Residency is completely at your own risk.
    8. Intent to vacate.
      1. Failure to submit a 30 days advance notice will result in a penalty in the cost amount of one full room of one months rent.
      2. Tenant agrees to allow potential future residents to view the unit and room as early as 30 days prior to move out date.
  4. All funds are to be made using $United States Dollars.
    1. Non-refundable application fee applies.
      1. Fee includes background, processing, previous rent history, and/or credit check at minimum.
    2. Security deposit in amount of 1.0 times the cost of one full room of one months rent per applicant is required.
      1. Security deposit is required at least 2 weeks before move in date to secure availability.
      2. Includes a mandatory retained recovery clean up security fee of $500 upon post residency move out.
    3. Monthly income must be at least 4 times higher than monthly rent.
      1. Proof of monthly income must be provided.
    4. Monthly rate must be paid through PayPal.
      1. Electronic Funds Transfer Subscription required for residencies longer than one month.
    5. Late fee penalty schedule:
      1. 1-2 days late: $75 added to rent.
      2. 3-4 days late: $100 added to rent. Disconnected: Internet.
      3. 5-6 days late: $125 added to rent. Disconnected: Internet, Electricity.
      4. 7+ days late: Agreement defaulted.
  5. Outstanding balances will be submitted to Collections Agency and your credit may be adversely affected.
    1. Any and all collections/recovery related fees will be added to the security deposit.
  6. Documentation Request.
    1. Documentation Requests are for copies of original documents only.
      1. No original documents will be sent.
    2. Documentation Requests may only be requested for past accounts.
      1. Documentation Requests may be requested at any time post document creation for any available records on file.
    3. Documentation Requests may only be requested for your own personal account due to privacy reasons.
      1. Documentation Requests made for other individuals will be rejected and documentation fee forfeited.
    4. Documentation requests can only be mailed to a current physical address within the United States of America for privacy reasons.
      1. Standard shipping.
        1. Standard request take 4-6 weeks (excluding delivery time).
        2. Cost is included in Documentation Request fee.
      2. Expedited request.
        1. Expedited request take 5-10 business days (excluding delivery time).
        2. An additional fee applies to expedited requests, as selected.
